Triumph & Disaster Wholesale Terms & Conditions

These Wholesale Terms & Conditions ("Terms") govern all applications for, and purchases made through, the Triumph & Disaster Wholesale Portal. By applying for a wholesale account, placing an order or accessing the wholesale portal, you acknowledge that you have read, understood and agree to these Terms.
1. Wholesale Account Approval
All wholesale account applications are subject to approval by Triumph & Disaster.
Submitting an application does not guarantee approval. Triumph & Disaster reserves the right to approve, decline, suspend or terminate any wholesale account at its sole discretion.
Applicants confirm that all information supplied is true, accurate and complete.
2. Approved Retailers
Wholesale accounts are available exclusively to approved retail businesses.
Retailers must promptly notify Triumph & Disaster of any changes to their business ownership, trading name, business address, website, online sales channels or contact information.
3. Minimum Order Requirements
- Minimum Opening Order: 6 units per SKU.
- Minimum Reorder: 6 units per SKU.
- Products must be ordered in multiples of 6 units per SKU, unless otherwise agreed in writing by Triumph & Disaster.
Triumph & Disaster reserves the right to amend minimum order quantities and product availability at any time.
4. Pricing
- Wholesale pricing is confidential.
- All prices are in Australian Dollars (AUD).
- Prices exclude GST unless otherwise stated.
- Prices are subject to change without notice.
5. Payment Terms
All wholesale orders are processed on a payment before dispatch basis.
Orders will only be processed and dispatched once full payment has been received and cleared.
6. Product Availability
All orders are subject to stock availability. Triumph & Disaster reserves the right to limit quantities, discontinue products or allocate stock where demand exceeds supply.
7. Delivery & Freight
Shipping costs and estimated delivery timeframes will be displayed at checkout or advised before dispatch.
Risk in the goods passes to the retailer once the goods have been delivered to the nominated delivery address or collected by the freight carrier.
8. Returns & Claims
Claims for damaged, missing or incorrectly supplied goods must be made within 5 business days of receiving the order.
Returns require prior written approval and must be unused, unopened and in their original packaging unless the goods were damaged or incorrectly supplied.
9. Third-Party Marketplace Policy
Triumph & Disaster products may only be sold through retail channels approved during your wholesale application.
Retailers must not advertise or sell Triumph & Disaster products on marketplaces including Amazon, eBay, Alibaba, Catch, Kogan, Facebook Marketplace or similar platforms without prior written approval.
Retailers must also not supply Triumph & Disaster products to businesses or resellers selling through these marketplaces.
Any breach of this policy may result in immediate suspension or termination of the wholesale account.
10. Brand Representation
Retailers agree to represent the Triumph & Disaster brand in a professional manner consistent with its premium positioning.
Retailers must not alter packaging, modify branding, use unauthorised marketing materials or make false or misleading product claims.
11. Online Sales
Retailers may sell Triumph & Disaster products online only through websites disclosed during the application process and approved by Triumph & Disaster.
12. Recommended Retail Pricing
Retailers are encouraged to maintain the recommended retail price (RRP) to preserve the premium positioning of the Triumph & Disaster brand.
13. Intellectual Property
All trademarks, logos, product names, photography, artwork and marketing materials remain the exclusive property of Triumph & Disaster.
14. Suspension & Termination
Triumph & Disaster reserves the right to suspend or terminate any wholesale account where these Terms are breached, including unauthorised sales channels, non-payment or conduct that damages the brand.
15. Privacy
Information provided during the application process will be used for account administration, order processing and business communications in accordance with Australian privacy laws.
16. Limitation of Liability
To the extent permitted by law, Triumph & Disaster's liability is limited to replacing, repairing or refunding defective goods supplied.
17. Governing Law
These Terms are governed by the laws of Australia.
18. Acceptance
By submitting a wholesale application or placing an order, you confirm that you have read, understood and agree to these Wholesale Terms & Conditions.
